If you are letting your property to private individuals, it will usually be let on an Assured Shorthold Tenancy (AST). This type of tenancy is attractive to Landlords as it offers market rents without security of tenure beyond the contractual term.

Certain criteria must be met:

• The tenant must be an individual
• The property is their main residence/home
• The rent must be less than £25,000
• The Landlord must not occupy the same property

Yes. This is usually the equivalent to 5 weeks rent and is taken from the tenant. Depending upon the service you choose, there will be a re-inspection, upon vacation of the property, and the deposit will be returned, provided all utilities have been settled, less any costs necessary for repairs and maintenance.

Under the Landlord and Tenant Act 1985, Landlords are responsible for the repair and maintenance of the structure and exterior of the property together with installations for the supply of gas, electricity, water and sanitation. If the property is not in a good state of repair at the commencement of the Tenancy, the tenant has the right to insist that repairs are carried out and, in the event that the damage is serious, the Tenant will be entitled to consider the letting as terminated as the Landlord is in breach of their obligations. If you are considered to be a non-resident Landlord living abroad, any managing agent is required by law to deduct and hold from net rent, after allowable expenses, tax at the current basic rate. This money is the passed to the Inland Revenue on a quarterly basis. You can apply to the Inland Revenue Financial Intermediaries Claims Office (FICO) for authorisation (by way of an exemption certificate) to receive payment of property rental with no tax deducted.
